1. Introduction

Welcome to iRemember, a digital platform that helps people capture, record, and publish personal life, community, club amongst other stories through audio, AI-assisted writing, and collaboration with family, members, writers and or editors.

By creating an account or using the App, you agree to these Terms and Conditions ("Terms"). Please read them carefully. If you do not agree, you must not use the App or its services.

2. Definitions

App / Platform
The iRemember mobile and web application, including all related websites, content, and technology.
User / You
Any individual using the App, including Story Owners, Writers, Collaborators, and Visitors.
Story Owner
The person who created the story.
Writer / Collaborator
A person authorised by the Story Owner, and by iRemember, to help capture, edit or manage the story.
Content
All text, audio, video, photos, and materials uploaded or created on the App.

3. Eligibility

To use iRemember, you must:

  • Be at least 18 years old; or
  • Have consent from a parent, guardian, or authorised representative.

By using the App, you confirm that all information you provide is true and accurate.

4. Account Registration

You must create an account to access most services. You are responsible for:

  • Maintaining the confidentiality of your login details;
  • All activity occurring under your account; and
  • Notifying us immediately if you believe your account has been compromised.

We may suspend or close accounts that breach these Terms or misuse the platform.

5. Services Provided

The App enables Users to:

  • Record spoken stories or interviews;
  • Use AI to transcribe and draft written stories;
  • Collaborate with Writers or Editors;
  • Edit, review, and publish stories;
  • Order digital or printed versions of completed stories.

We may update or modify the App and its features at any time.

6. Use of AI and Automation

Our platform uses artificial intelligence (AI) to assist in transcribing, editing, and generating written content.

AI output is generated automatically and may contain inaccuracies or biases.

You are responsible for reviewing and approving all final content before publication or sharing.

iRemember is not liable for errors or omissions in AI-generated content.

7. Content Ownership

You retain full ownership of the personal stories, audio, and materials you upload ("Your Content").

By uploading or creating Content, you grant iRemember a non-exclusive, royalty-free licence to host, store, and process it for the purpose of operating the App and providing services.

You warrant that you own, or have permission to use, all Content you upload.

You may delete Your Content at any time. Upon deletion, we will remove it from our active systems within a reasonable period.

8. Writer / Collaborator Relationships

Story Owners may engage Writers or Collaborators to help produce their stories.

Writers are independent contractors, not employees or agents of iRemember.

Any agreement, payment, or arrangement between a Story Owner and a Writer is the responsibility of those parties, unless otherwise provided by iRemember.

iRemember may facilitate payments between parties but does not guarantee performance, timelines, or outcomes of Writer services.

9. Payments and Fees

Fees for using the App or hiring Writers, printing books are displayed at the time of purchase or project setup.

Payments are processed securely via approved third-party payment gateways, such as Stripe or PayPal.

iRemember may charge a service fee or commission for platform use.

All prices are listed in Australian Dollars (AUD) and include GST unless stated otherwise.

Refunds are only available as required by Australian Consumer Law (ACL) or under our Refund Policy.

10. Intellectual Property

All platform technology, design, software, AI models, and materials created by or for iRemember remain our exclusive property. You must not copy, reproduce, or reverse-engineer any part of the App.

11. Privacy

We respect your privacy and handle your personal information in accordance with the Privacy Act 1988 (Cth) and our Privacy Policy, available on our website.

By using the App, you consent to the collection, use, and processing of your information as described in that policy.

12. Acceptable Use

You must not use the App to:

  • Upload unlawful, defamatory, or offensive material;
  • Infringe on another person's copyright, privacy, or rights;
  • Interfere with platform security or other users' access; or
  • Attempt to copy or exploit the App's source code or data.

We reserve the right to suspend or terminate accounts for misconduct.

13. Availability and Technical Issues

We aim for continuous availability but do not guarantee uninterrupted access.

The App may occasionally be unavailable due to maintenance, updates, or technical issues.

iRemember is not liable for loss of data, delays, or errors caused by network or third-party service interruptions.

14. Liability and Disclaimers

To the fullest extent permitted by law:

  • iRemember provides the App "as is" without warranties of any kind;
  • We do not guarantee that AI output or stories will be error-free or suitable for a specific purpose;
  • Our total liability for any claim is limited to the amount you paid for the service giving rise to the claim;
  • All content contained within your book has been provided, selected and approved by the user(s), who retain full responsibility for its accuracy, originality and any necessary permissions. iRemember accepts no liability for errors, omissions or infringements relating to the content.

Nothing in these Terms excludes your rights under the Australian Consumer Law.

15. Termination

You may delete your account at any time.

We may suspend or terminate your access if you breach these Terms, misuse the App, or engage in illegal activity.

Upon termination:

  • Your licence to use the App ends immediately;
  • We may retain limited data as required by law or for legitimate business purposes.

16. Changes to These Terms

We may update these Terms periodically. Updated versions will be posted within the App and take effect upon publication. Continued use of the App means you accept any changes.

17. Governing Law

These Terms are governed by the laws of New South Wales, Australia, and you submit to the exclusive jurisdiction of its courts.
